Mahkamah Konstitusi (MK) adalah lembaga tinggi negara dalam sistem ketatanegaraan Indonesia yang merupakan pemegang kekuasaan kehakiman bersama-sama dengan Mahkamah Agung. Keberadaan MK dirasa sangat penting dan strategis karena MK berupaya mengawal konstitusi agar dilaksanakan dan dihormati keberadaannya. Selain itu, MK mempunyai dasar legitimasi, juga memiliki landasan yang kuat dan sangat dibutuhkan dalam sistem ketatanegaraan. Pada dasarnya dalam proses pembentukan Mahkamah Konstitusi di Indonesia tidak terlepas dari kajian pemikiran dari segi politis-sosiologis, yuridis dan filosofis, serta historis. Dilihat dari aspek kelembagaannya, Mahkamah Konstutusi berbeda dengan lembaga negara lainnya. Mahkamah Konstitusi di samping sebagai “lembaga negara”, juga sebagai “lembaga UUD 1945”. Sebagai lembaga negara, artinya lembaga yang harus dimiliki oleh setiap negara agar negara tersebut disebut negara demokratis dan negara hukum. Sedangkan sebagai “Lembaga UUD 1945”, artinya Mahkamah Konstitusi sebagai komponen konstitusi yang harus dimasukkan ke dalam setiap UUD dalam suatu negara karena merupakan tiang atau penyangga utama dari suatu yang namanya UUD. Dalam wacana pembahasan tentang wewenang Mahkamah Konstitusi, terlebih dahulu harus memperhatikan tentang bagaimana kedudukan Mahkamah Konstitusi dalam sistem ketatanegaraan kita dan bagaimana landasan Mahkamah Konstitusi dalam UUD 1945, serta apa saja yang menjadi wewenangnya. Adapun wewenang utama Mahkamah Konstitusi adalah menguji undang-undang dan menyelesaikan sengketa antara lembaga negara. Tugas dan wewenangnya ini perlu dikaji melalui pengaturan perundang-undangan dalam sistem hukum positif di Indonesia. Materi dalam buku ini yang juga digagas dari hasil penelitian, dibahas dengan detail bagaimana legitimasi teori konstitusi atas perubahan Undang-Undang Dasar 1945 terhadap kekuasaan kehakiman; dasar teoretis dan yuridis kewenangan MK, termasuk di dalamnya perbandingan wewenang menguji dan lembaga yang melakukan pengujian di beberapa negara, seperti Amerika, Prancis, Jerman, dan Korea Selatan.
