Penerapan Lembaga Dwangsom (Uang Paksa)

di Lingkungan Peradilan Agama

Satu di antara persoalan penting terkait dengan putusan pengadilan adalah mengenai tuntutan dwangsom (uang paksa). Meskipun tuntutan dwangsom hanya bersifat tambahan (accesoir) bagi hukuman pokok. Namun hakim dalam memeriksa, mengadili, dan memutus tuntutan tetap dituntut kesungguhan dan kehati-hatian. Hal tersebut dilakukan agar kepentingan hukum yang ingin dicapai dari penerapan lembaga dwangsom dapat terwujud hingga benar-benar bermanfaat bagi penyelesaian perkara bersangkutan. Sejauh ini, penerapan lembaga dwangsom di pengadilan ternyata masih menyimpan banyak masalah, antara lain: putusan hakim yang tidak relevan dengan aturan yang ada mengenai dwangsom; tidak jelasnya patokan dasar yang digunakan dalam menolak atau mengabulkan tuntutan tersebut; dan inkonsistensi putusan hakim yang satu dengan lainnya mengenai dwangsom. Timbulnya berbagai masalah tersebut tidak terlepas antara lain karena aturan formal dan pedoman teknis yang belum memadai serta masih langkanya literatur/ referensi yang membahas secara spesifik mengenai penerapan dwangsom itu sendiri. Kehadiran buku ini tidak terlepas dalam upaya mengatasi berbagai masalah tersebut.
